Planning - Crown immunity Print
Traditionally, developments carried out by the Crown (including government departments) are not subject to local planning control (although government departments are required to consult over planned developments). That has now largely changed, as a result of Planning and Compulsory Purchase Act 2004 having come into force last month. Minor exceptions still apply, but the basic principle now is that the Crown is no longer immune in planning matters.
