Leasehold register - change |

You can expect to see different leasehold property registers as from 19
June. The existing, traditional, entry is:
'This register describes the land and estate comprised in the title. Except as
mentioned below, the title includes any legal easements granted by the registered
lease but is subject to any rights that it reserves, so far as those easements and
rights exist and benefit or affect the registered land.'
But, as from 19 June, the heading appearing on new leasehold registers will
be identical to that on freehold titles:
‘This register describes the land and estate comprised in the title.’
In addition, there will then be separate entries in the register referring to the
various rights in the lease (extracted from the prescribed clauses). Also, all
existing lease registers are being changed, so expect to see these words:
'Unless otherwise mentioned, the title includes any legal easements granted by
the registered lease but is subject to any rights that it reserves, so far as those
easements and rights exist and benefit or affect the registered land.'
