LTA 1954 changes – renewal |

One of the most important changes as from 1 June is the abolition of the requirement that T serves a counter-notice in response to L’s s25 notice. Instead, both parties have to serve or respond to any notice in a prescribed form within strict time limits to renew the tenancy. An s25 notice enables L to end the tenancy, while an s26 notice allows T to request a new tenancy.
L’s s25 notice has to specify a termination date after the date when the contractual term ends. That termination date is to be not less than six months and not more than 12 months after service of the notice. T can still serve an s26 notice requesting a new tenancy, setting out his proposals for that new tenancy. Note that under the new rules L now has to set out his proposals for a new tenancy in his initial s25 notice. [2004] EG 17 April 108.
