The earliest date that T can apply to the court for a new tenancy will depend upon whether L opposes the renewal. If L does not (ie by serving a counternotice, or alternatively serving a positive notice saying he will not oppose) no application can be made for two months from the date of making the s26 request.
However, if L opposes the renewal, then as soon as L serves notice to that effect, either L or T can apply to the court without having to wait for the two-month period to expire. But if it is L who has initiated the process by serving an s25 notice then either L or T can start the court proceedings (there is no longer a need to wait two months).
