Repossession - mortgagee Print

Prior to the dissolution of parliament, the Mortgage Repossessions (Protection of Tenants) Act 2010 was pushed through. What the Act does is to give protection to Ts who find themselves being evicted by L’s mortgagee (when L has failed to get proper consent for the let). In essence, the Act gives the court power to suspend an order for possession by up to two months; this right to suspend can only be exercised once (so Ts cannot keep making further applications). It applies to tenancies under HA 1988 or RA 1977. Note that the Act is not in force yet and a commencement order will need to be made.
