Leases - compulsory registration Print
Prior to October 2003, it was only new leases of 21 years or more that needed to be registered at the Land Registry. But, since then, the trigger for compulsory registration has been a lease of more than seven years. Surprisingly, it is reported in the latest issue of the LR’s Landnet magazine that a substantial number of these shorter leases are being registered for SDLT purposes with HMRC, but are not then being lodged for registration at the LR. In other words, it seems that a lot of leases are not being registered that should be registered. You have been warned!
