Two new ‘triggers’ for compulsory first registration of land came into force on 6 April.
- the appointment of a new trustee of unregistered land held in trust (this will include a memorandum executed as a deed under s83 Charities Act 1993, as well as a vesting order under s44 Trustee Act 1925); and
- the partitioning of unregistered land held in trust among the beneficiaries of the trust.
Do not forget that trustees of unregistered land can still continue to apply for voluntary registration (and so receive the 25% fee reduction) until such time as they appoint a new trustee, and so trigger compulsory first registration.
