Land Registry - new forms Print
Do not forget that from 10 November, all LR forms will change. The new versions of AP1, FR1 and DS2 are mandatory for all applications received on or after 10 November. For all other forms there is a transitional period lasting until 9 February 2009, during which time you can continue to use up your old forms, but thereafter the new versions must be used. Other changes to note:
  • Applying to cancel a home rights notice: continue to use form HR4, but it is now a prescribed form (which means you no longer also have to use form AP1).
  • Severance of a joint tenancy: there is a new form (SEV) which may be used to apply for a Form A restriction when there has been a severance of a joint tenancy by agreement or notice (in which case you no longer use form RX1).
  • Statements of truth: these have now been introduced as a means of providing evidence to support an application. The statement of truth is signed, but need not be sworn or witnessed and can be used as an alternative to a statutory declaration. Forms ADV2 and CT1 now have statements of truth, rather than statutory declarations; in addition there are four new forms containing statements of truth (ST1, ST2, ST3, and ST4).
  • Evidence of identity: there are panels confirming identity that now have to be completed on AP1, FR1 and DS2.
  • Issuing documents to a third party: there is no longer the facility to ask the LR to issue documents to a third party on completion of an application.
  • Restrictions: the wording of most of the standard restrictions has been amended.

Most practitioners should have received the Action Booklet from the LR (if not, it is available on www.landregistry.gov.uk ).
