Reg 2 of HIP (Amendments) Regs 2008 came into force on 31 March. If
a new home is to be marketed, the HIP must include a sustainability
certificate (which is a certified assessment of the home against the Standards in the Code of Sustainable Homes). This new requirement
only applies to new homes being designed or constructed, or new homes
that have been constructed but never occupied, and will not apply to
existing properties being converted.
Note that there are transitional arrangements that mean the
requirements of Reg 2 only apply to those homes that are at the
beginning of the construction process (and not to those that are already
being built). This is because Reg 2 only applies where the LA has
received a building notice, initial notice, or full plans application after 1
May 2008. In effect, it will only affect new homes for which applications
for building regs approval has been received by the LA after 1 May. Note
also there is no obligation to get a Code assessment done (ie Reg 2
merely provides for either a sustainability certificate, or an interim
certificate, or a nil-rated assessment, to be included in the HIP). © Practical Lawyer
