It is not generally appreciated that buy-to-let mortgage lending is
unregulated and outside the scope of general consumer credit
legislation.
Conveyancers acting for novice buy-to-let purchasers might
be wise to point this out to their clients (ie they do not have the same
protection as if they were taking out a mortgage on a conventional home
purchase). In time the Consumer Credit Act 2006 will change that, but
not until April 2008 (although even then it will not apply to those who are
in ‘business’ – which probably means those with more than a couple of
buy-to-lets). © Practical Lawyer
