Land Registry – position of entries |
|
Continuing computerisation of LR entries means that the future order
and position of some entries in the register will change. There will be no
change to existing registers, and entries will be fixed in place (ie they will
not be moved on subsequent applications). But in the future, entries will
no longer be positioned in a particular place among existing entries as
a result of a dealing application.
In practice, entries will be placed in the
next available position in the relevant part of the register (unless they
are charge registers). For instance, in the past an application for
determined boundaries would result in the new entry being positioned
immediately after entry A1 in the Property Register, but in the future it
will go at the bottom (next available position) of that register. Note that
all of this is merely administrative; it has no effect on the priority of
charges. But it does mean that you may have to look more carefully, and
you should be aware that in the future entries may no longer be in the
position that you previously expected them to be. © Practical Lawyer
