Two important points to note:
- confidential documents: letters objecting to the registration of a plot
of land are often marked ‘confidential’. The LR has now said that all
documents must be treated as potentially discloseable even if they
are marked ‘confidential’. Accordingly, standard practice will now be
to return such documents and suggest that they are resent on a nonconfidential
basis (unless it is reasonable to assume that the sender
is aware of the policy regarding ‘confidential documents’– which
presumably means that there is a danger of a confidential document
being disclosed elsewhere). In any event, the key point to appreciate
is that you cannot expect to be able to write to the LR in confidence;
- OS plans: the LR will now reject all applications for land registration
where the extent of the land cannot be related to an OS map. Whereas
this policy previously only applied to leases, it now applies to all land.
