Section 106 - model agreement Print
Planning obligations between a developer and a LA are usually entered into under a s106 TCPA 1990 agreement. Such agreements can also be made unilaterally by a developer. As part of a drive to ensure there is some consistency throughout the country, the Department for Communities and Local Government (which has replaced the ODPM) has published practice guidance for developers and LAs. This includes a model s106 agreement prepared by the Law Society’s Planning and Environmental Law Committee (and there are also notes on drafting affordable housing provisions). These can be downloaded from www.communities.gov.uk. © Practical Lawyer
