Environmental Impact - reserved matters
The ECJ has held that an Environmental Impact Assessment may need to be carried out at the reserved matters stage of the planning process, if it becomes apparent then that the whole project is likely to have significant effects on the environment. The ECJ decision means that the EIA Regs and Circular 02/99 will have to be amended.
Anti-socials – powers
What this table summarises are the powers that are available to housing providers in respect of anti-social behaviour. Note that even more powers are currently in the legislative pipeline – see article in [2006] SJ 595.
Smoking - health and safety
As long ago as 1997, a secretary in a law firm was able to successfully argue constructive dismissal because the employing firm refused to implement a no-smoking policy (Waltons and Morse [1997]). Since then, of course, things have moved on and we can now expect the Health Bill (which contains compulsory workplace smoking bans) to be in force in 2007.
Mines and minerals - LR Guide
There is a new LR guide (Practice Guide 65) on LR practice for the registration of mines and minerals under LRA 2002. It is available at www.landreg.gov.uk.
DCLG – what is it?
The ODPM (Office of the Deputy Prime Minister) has been replaced by a new acronym – DCLG (the Department for Communities and Local Government).
Remediation – tax break
